Patients impacted by a healthcare data incident now have access to financial relief and protective services in a newly approved class action resolution.
Aspire Health Alliance, a healthcare provider offering mental health and related services, has agreed to the $400,000 settlement resolving claims stemming from a 2023 breach.
The lawsuit was launched because the company allegedly failed to adequately protect sensitive patient data from unauthorized access, including names, dates of birth, dates of medical services, individual health insurance policy numbers, physician or medical facility information, medical condition or treatment information, Medicare or Medicaid numbers and patient accounts.
Affected individuals who received notice can receive automatic pro rata cash payments from the fund plus one year of medical data monitoring, or file a claim for up to $2,500 in documented out-of-pocket losses.
Plaintiffs accused Aspire Health Alliance of negligence in its data security practices that led to the compromise of records.
The complaint claims the defendant’s lapses caused risks of identity theft and unauthorized access for affected individuals.
Aspire denies that it did anything wrong.
Eligible class members can receive cash distributions along with credit or medical monitoring services to mitigate risks.
The exact distribution details will follow court finalization of the agreement.
